1. Do breeding farms require land approval?

The "National Land Classification" and "Request for Instructions on How to Handle Land Used for Breeding" formulated by the Ministry of Land and Resources stipulate that breeding land belongs to agricultural land, and building breeding houses on it does not constitute an act of changing the land use. The occupation of arable land other than basic farmland for breeding is no longer subject to approval as construction land or temporary land.

Article 12 Administrative licenses may be set for the following matters: (1) matters that are directly related to national security, public security, economic macro-control, ecological environmental protection, and specific activities that are directly related to personal health, life and property safety, and that need to be approved in accordance with statutory conditions; (2) matters that require the granting of specific rights, such as the development and utilization of limited natural resources, allocation of public resources, and market access to specific industries that are directly related to the public interest; (3) matters that require the determination of qualifications and qualifications such as special credibility, special conditions or special skills for professions and industries that provide public services and are directly related to the public interest; (4) matters that require the review and approval of important equipment, facilities, products, and articles that are directly related to public security, personal health, life and property safety, through inspection, testing, quarantine, etc. in accordance with technical standards and technical specifications; (5) matters that require the determination of the subject qualifications, such as the establishment of enterprises or other organizations; and (6) other matters that may be set for administrative licenses as provided by laws and administrative regulations.

Article 29 Where a citizen, legal person or other organization is required to obtain an administrative license for a specific activity in accordance with the law, it shall apply to the administrative organ. If the application needs to be in a formatted text, the administrative organ shall provide the applicant with a formatted text of the application for administrative license. The formatted text of the application shall not contain any content that is not directly related to the application for administrative license. The applicant may entrust an agent to submit an application for administrative license. However, this does not apply to cases where the applicant is required by law to submit an application for administrative license at the office of the administrative organ. An application for administrative license may be submitted by letter, telegram, telex, fax, electronic data exchange, or e-mail.

Article 71 Where an administrative license is established in violation of the provisions of Article 17 of this Law, the relevant authorities shall order the authority that established the administrative license to make corrections or revoke it in accordance with the law.
