CATDOLL: Is it illegal to catch wild yellow croaker?

As long as you don't fish during the closed season, it's not illegal.

Yellow croaker was once one of China's important economic fish. It is a local species unique to China and is widely distributed from the southern Yellow Sea in the north, through the East China Sea and the Taiwan Strait, to the east of the Leizhou Peninsula in the South China Sea in the south. This fish is a warm-temperature schooling fish...

As long as it is no longer during the fishing ban period, it is not illegal. The fishing ban period is from 12:00 on April 1st to 12:00 on June 30th every year.

During the closed fishing period, all fishing operations including fishing gear are prohibited in the closed fishing area. In other words, all wild fish in the Yellow River will be prohibited from being caught.

The fishing ban area includes the main stream of the Yellow River and three major lakes connected to the river, namely Zhaling Lake, Eling Lake and Dongping Lake, as well as the main stream sections of 13 major tributaries of the Yellow River, namely Baihe River, Heihe River, Taohe River, Huangshui River, Dahaihe River, Kuye River, Wuding River, Fenhe River, Weihe River, Luohe River, Qinhe River, Jinti River and Dawen River.

Fishing ban in the Yangtze River Basin

The fishing closed season is from March 1 to June 30 every year.

During the closed fishing period, all fishing operations are prohibited in the closed fishing areas. In addition, if the natural fishery resources of the Yangtze River need to be harvested for aquaculture production or scientific research, approval must be obtained from the fishery administrative department at or above the provincial level in accordance with the special fishing management regulations formulated by the Ministry of Agriculture.

The fishing ban area includes the main stream section of the Yangtze River from Qumalai County, Qinghai Province to the Yangtze River estuary (122° east longitude); the main stream sections of important rivers connecting the Yangtze River such as Minjiang River, Tuojiang River, Chishui River, Jialing River, Wujiang River, and Hanjiang River in Gansu Province, Shaanxi Province, Yunnan Province, Guizhou Province, Sichuan Province, Chongqing City, and Hubei Province; the main stream section of Dadu River in Qinghai Province and Sichuan Province; Poyang Lake and Dongting Lake; and the main stream section of the Huaihe River.

East China Sea fishing ban

According to the Fisheries Law of the People's Republic of China and the Fisheries Management Regulations of Zhejiang Province, from 12:00 on April 1, all fishing vessels are prohibited from catching swimming crabs, parent crabs and juvenile crabs; from 12:00 on April 16 to 12:00 on July 1, the fishing of hairtail will also be banned.

From May 1 to September, Zhejiang will enter a comprehensive fishing moratorium period, and all types of marine fishing operations except fishing gear will be prohibited.

The spawning period of swimming crabs along the Zhejiang coast is generally from April to July each year. The young crabs hatched in spring grow faster, generally molting about 8 to 10 times a year, weighing about 3 taels, and becoming "adults" after sexual maturity, but they can only be considered "juvenile crabs" that have just grown up, which takes at least 5 months.

This is also the main reason why the fishing ban period for egg-bearing swimming crabs and juvenile crabs is as long as 5 and a half months.

In addition to the above three places, starting from March 1, important waters such as the Pearl River Basin, Huaihe River, Minjiang River and inland waters of Hainan Province have also officially entered a four-month spring fishing ban period.

These ingredients are prohibited from fishing and purchasing

In the fishing ban notices issued in various places, in addition to the complete ban on fishing operations in the Yellow River, Yangtze River and other river basins, all kinds of markets including aquatic trading markets, farmers' markets, supermarkets, temporary stalls and other catering establishments in Zhejiang Province are prohibited from selling eight kinds of seafood, including hairtail, large yellow croaker, small yellow croaker, silver pomfret, mackerel, three-spotted swimming crab, dragon head fish, and mantis shrimp.

One week after the fishing ban begins, the sale of live or chilled products of the above eight types of seafood will also be banned.

At the same time, the sale of juvenile fish that do not meet the minimum catchable transitional size of six key protected marine fishery species, including hairtail, small yellow croaker, large yellow croaker, silver pomfret, mackerel, and swimming crab, is banned throughout the year.

The specific catchable specifications are as follows:

The fishing of Yangtze River eel fry is banned all year round

It is worth mentioning that in addition to the seafood species that are banned from fishing during the closed fishing period mentioned above, there is one type of fish that is banned from fishing all year round - that is the Yangtze River eel fry.

This means that even during the fishing period, the state strictly prohibits anyone from catching eel fry in order to protect aquatic resources and the ecological environment.

In recent years, due to overfishing, water environment and other factors, the production of eels has been declining year by year, resulting in a supply shortage in the market and rising prices.

As market demand continued to increase, people began to engage in large-scale artificial breeding to meet market demand. As a result, eel fry became a "hot commodity" and was known as "soft gold".

The previously highly-publicized case of illegal fishing of eel fry in the Yangtze River basin was also recently publicly sentenced at the first instance.

It is reported that this case is the first case of illegal fishing of aquatic products in the country that has occurred in the Yangtze River Basin since the relevant national departments adjusted the fishing ban system in the Yangtze River Basin, and it has implemented a "full-chain" crackdown from fishing, purchasing to trafficking.

Among the 53 people sitting in the dock, there were not only illegal persons who fished privately during the fishing ban period, but also more than a dozen people who purchased illegal catches from fishermen, which shows how strong the law enforcement is.

Conclusion

After the fishing ban, the fishery administration, maritime police, public security and border defense departments will strengthen supervision and inspection of fishing boats, fishing ports, and the sale and use of fish. In other words, not only is fishing illegal during the fishing ban, but selling and cooking wild fish is also illegal.

Fishery law enforcement officers will not only conduct irregular inspections in major fishing ban areas, but also conduct surprise inspections of local vegetable markets and catering establishments. Localities have also established relevant reporting systems. If illegal fishing is found, the fishery authorities will impose penalties in accordance with the law; if a crime is constituted, the judicial authorities will be held criminally responsible in accordance with the law.

Therefore, chefs need to pay attention to the source of ingredients when purchasing and never purchase wild fish, otherwise they may face legal penalties!

I hope you can learn from this and not knowingly violate the law and still do it, and do not purchase banned food for profit. The price of wild yellow croaker in Shipu is as follows. The purchase price of a single fish weighing 1-2 catties is about 1,300 yuan per catty, 2-3 catties is 2,300 yuan per catty, and 3-4 catties is 3,300 yuan per catty.

Wild yellow croaker is comparable to gold. With the decrease in production in recent years, its value has become increasingly expensive.

However, it seems that with the implementation of measures such as fishing ban and releasing fish, the resources of yellow croaker have recovered to some extent.

On January 15, someone also bought more than 900 kilograms of wild yellow croaker for more than 1 million yuan. The fish was caught by another boat captain in one net.

As long as you don't fish during the closed season, it's not illegal.
